Employers with 75 or more employees in Ohio and all nonresidential construction contractors must use E-Verify for new hires and maintain verification records, while nonresidential construction project contracts must require contractors and subcontractors to use E-Verify for tradespersons assigned to the project. The Attorney General will investigate complaints of violations and can bring civil actions against violators, with courts ordering a $5,000 penalty per violation and barring violators from state contracts for one year if a violation is found.

Ohio E-Verify Expansion Act

This bill aims to modify the law regarding individuals who are unlawfully present in the United States, requiring state and local authorities to cooperate with the federal government in the enforcement of immigration laws and sanctioning those who fail to do so. Under these provisions, The superintendent of the state highway patrol shall create, operate, and maintain a statewide database of criminal activity involving illegal aliens. The superintendent may contract with state or private entities, including private software and technology providers, to create, operate, and maintain the database. The database shall include information concerning each known instance where an illegal alien is charged with or convicted of a crime and each known alleged violation of federal immigration law occurring in the state, including each alleged instance of unauthorized employment. No state or local governmental entity shall adopt an ordinance, policy, directive, rule, or resolution that prohibits or otherwise restricts a public official or employee from doing any of the following: (1) Complying with the requirements of division (B), (D), or (E) of this section; (2) Inquiring about a person's name, birthdate, place of birth, or citizenship or immigration status in the course of investigating or prosecuting a violation of any law or ordinance; (3) Maintaining information about a person's citizenship or immigration status; (4) Sending information to, or requesting or receiving information from, a federal, state, or local government agency or employee concerning a person's citizenship or immigration status or for the purpose of determining a person's citizenship or immigration status; etc.

The Ohio Withholding Illegal Revenue Entering Drug Markets (WIRED) Act levies a 7% remittance transfer fee on money transmissions from customers in Ohio to persons outside the United States made by licensees and authorized delegates. This fee revenue is deposited into a state fund used to make grants to law enforcement agencies for costs related to illegal immigration, human trafficking, and drug trafficking. The act allows Ohio taxpayers to claim a refundable income tax credit equal to the amount of remittance transfer fees they paid during the year, up to $2,000 annually.

Withholding Illegal Revenue Entering Drug Markets (WIRED) Act

This bill would criminalize unauthorized presence in Ohio as a fifth-degree felony with a mandatory 12-month prison term and $500 minimum fine. Repeat offenders or previously deported individuals would face fourth-degree felony charges with $1,000 fines. The legislation requires law enforcement to collect biometric data and check federal security databases, while requiring offenders to leave Ohio within 72 hours after conviction or release. The bill includes limited exemptions for DACA recipients and those seeking asylum or visa renewal, though community control sanctions would be prohibited for all offenders.
