The bill mandates that state agencies and political subdivisions include provisions in their public improvement and service contracts requiring contractors to use E-Verify for all employees hired during the contract term or assigned to work on the contract within Ohio, with contracts lacking such provisions being void. The Attorney General will conduct compliance reviews and can fine state agencies and political subdivisions $5,000 per violation. Employers with 75 or more employees in Ohio and all nonresidential construction contractors must use E-Verify for new hires and maintain verification records, while nonresidential construction project contracts must require contractors and subcontractors to use E-Verify for tradespersons assigned to the project. The Attorney General will investigate complaints of violations and can bring civil actions against violators, with courts ordering a $5,000 penalty per violation and barring violators from state contracts for one year if a violation is found.

The Ohio Withholding Illegal Revenue Entering Drug Markets (WIRED) Act levies a 7% remittance transfer fee on money transmissions from customers in Ohio to persons outside the United States made by licensees and authorized delegates. This fee revenue is deposited into a state fund used to make grants to law enforcement agencies for costs related to illegal immigration, human trafficking, and drug trafficking. The act allows Ohio taxpayers to claim a refundable income tax credit equal to the amount of remittance transfer fees they paid during the year, up to $2,000 annually.

This bill aims to enact a new section in the Ohio Revised Code to restrict state low-income housing tax credits to projects that confirm the immigration status of their tenants. The bill requires project owners to prohibit renting to individuals unlawfully present in the US and mandates prospective tenants to provide specific documentation proving legal presence, such as birth certificates, passports, etc. Additionally, owners must retain copies of these documents for the duration of the tenant's stay and permit the Attorney General access to these records upon request. Failure to comply with these regulations can result in the revocation of the tax credit. The Attorney General is authorized to investigate violations of these stipulations, and if a violation is found, evidence will be forwarded to the agency overseeing the tax credit.
