Senate leadership refused to move this bill which aims to adjust the existing income tax credit for organ donors and introduce a new income tax credit for employers providing paid leave to organ donors. The proposed nonrefundable credit applies to qualifying employers or individuals with an interest in such employers who offer donation leave benefits to employee donors. For each living donation, the credit is capped at the lesser of the actual donation leave benefits paid to the employee or $300 per day, not to exceed 30 days. Qualifying employers can claim the credit in the taxable year when the donation leave benefits are paid, while individuals with an equity interest in such employers claim their share of the credit in their taxable year, including the last day of the entity's taxable year. "Qualifying employer" means a taxpayer or a passthrough entity who is registered and authorized to use the e-verify federal employment verification program jointly administered by the United States department of homeland security and the social security administration under 8 U.S.C. 1324a, or any of its successor programs.
