Any entity that adopts policies violating this legislation risks losing state funding. Under this bill, the attorney general would be authorized to provide legal defense for any entity or agency facing litigation due to their good-faith efforts to comply with these new regulations.

West Virginia Immigration Enforcement Act

requires state and local entities and law enforcement agencies to cooperate with federal immigration law enforcement. The bill prohibits policies that restrict immigration enforcement, establishes mandatory duties regarding immigration detainers, and requires jails to enter agreements for housing detained individuals. It creates a complaint procedure through the Attorney General, includes whistleblower protections, and allows civil actions for damages against entities that violate the law. Entities that don\'t comply may lose state funding. The bill prohibits discrimination based on race, color, religion, language, or national origin in enforcement.

amends the state's human trafficking laws by adding a definition for "illegal alien" and making changes to restitution provisions. The bill defines an illegal alien as someone who entered the U.S. illegally and is deportable, or someone who entered legally but is now "out of status" and deportable. It specifies that any entity transporting illegal aliens into West Virginia is engaging in human trafficking. The bill also prohibits illegal aliens from receiving restitution under trafficking laws, instead directing any restitution payments to the State of West Virginia.

Cracking down on Illegal Alien Human Trafficking Act

This legislation toughens human trafficking laws regarding illegal aliens and ensures that bringing illegal aliens into the state of West Virginia is correctly categorized as human trafficking.

This bill aims to require employers in the state to use the federal E-Verify system to confirm the identity and legal work status of their employees. Some exceptions are made for the relationship between a party and an independent contractor, casual domestic labor, and individual homeowners hiring workers on their private property. The Commissioner of the Division of Labor is empowered to investigate complaints, access information from other state agencies to confirm compliance, and impose penalties for violations, including license suspensions of 10 to 60 days for first and second offenses and permanent revocation for a third offense. Employers have affirmative defenses available, such as good faith compliance with E-Verify requirements and entrapment. The Division of Labor will provide educational materials and notifications to make employers aware of the E-Verify requirements. The bill seeks to ensure that employers in West Virginia are only employing individuals legally authorized to work in the United States and provides for strong enforcement mechanisms and penalties to deter the employment of illegal aliens. This motion failed to get the necessary 2/3rd votes for passage.
